Oh the trial was a breeze, verdict was NOT GUILTY! The state didn't make their case at all.
Let me setup the crime scene for you. This couple was sitting in their pickup in front of this guys aunts duplex arguing while the other tenant couple was outside their apartment arguing at 10:30 at night.
The lady outside arguing was the first witness. She said she heard the lady in the pick up shout stop your hurting me. When the lady in the truck got out she said she saw she had a black eye. She claimed the victim asked her to call police. The defence attorney asked her if she wasn't convicted for giving police misinformation and she denied it but then the defence attorney said she was in fact convicted twice for giving police misinformation. Once the defence attorney produced the documentation the lady admitted she had once lied to police but the second time she just plead guilty for a lesser sentence.
The second witness a police officer talked about the night of the crime. He said her took a statement from the neighbor lady and the defendant admitted to hitting the fiancee. He didn't bring his note from that night but went on recollection.
The prosecution rested the defence called the victim. She said while arguing she slapped the defendant three to four times but he didn't hit her. He simply raise his arms in self defence. She was drunk at the time and was arrested as well for drunk and disorderly. She says she did not tell the neighbor to call the police.
The next witness was the defendant. He said the same as his fiancee that she had slapped him. He said he told the police he may have hit her when he raised his arms to defend himself.He said the police told him he should have just sat there and taken it and they arrested him.
This was such a sloppy case I can't believe it went to trial. The one woman on the jury was selected as the foreman. It was over by noon. We all right away said the state had no case. We mostly agreed it could have been as accused but the evidence wasn't there to prove beyond a reasonable doubt.
